例えば、就労ビザや日本の大学等に留学で在留している外国人（本体者）に付随して被扶養者に認められます。

（１）ここでいう配偶者は、婚姻が法律上続いている者だけです。よって、内縁の配偶者、外国で有効な同性婚者（但し、同性婚のパートナーについては「特定活動」ビザで許可される可能性があります。）、は含まれません。
ビザの本体者（就労や留学の人）が死亡したり、本体者と離婚した場合は、当然単独で「家族滞在」ビザを維持することはできません。

（２）ここでいう子は、嫡出子、養子（普通養子含む）、認知された非嫡出子となります。
なお、子が成年者であっても含みます。

（３）本国の親を日本に呼び寄せたいと考える人は多いですが、親は対象外となっています。
